In short: Who is liable for your shipment depends on who performs the transport. If Maxmove fulfills the order itself ("Fulfilled by Maxmove"), Maxmove is liable under the German Commercial Code (HGB) like a freight forwarder. If Maxmove brokers the order to a driver or fleet, that carrier is responsible under the HGB. You can also book additional transport insurance.
Orders fulfilled by Maxmove
- If Maxmove is the fulfilling company on your order ("Fulfilled by Maxmove"), Maxmove is liable for loss of or damage to your shipment during transport under §§ 425 ff. HGB.
- This liability is generally capped at 8.33 special drawing rights per kilogram of gross weight (§ 431 HGB).
Brokered orders
- For brokered orders, your transport contract is with the driver or fleet who performs it. Maxmove only brokers the order and is not liable for the shipment.
- The carrier performing the transport is responsible. Carrier liability under §§ 425 ff. HGB applies to them, generally capped at 8.33 special drawing rights per kilogram (§ 431 HGB).
Additional insurance
- For higher-value goods, you can book transport insurance on top of the statutory liability.
