What retailers should settle before delivery

German sales law, carriage law and the Electrical Equipment Act set out who is responsible for what in furniture delivery.

  • Delivery date: 30 days at most without agreement

    If a sales contract with a consumer sets no delivery date, the customer can demand delivery without undue delay, and the retailer must hand over the goods no later than 30 days after the contract was concluded (§ 475(1) BGB, German Civil Code). If a date was agreed, that date applies. For stock items that are only waiting for the next free round, a booked direct drive closes the gap. Record the promised date in the order so pickup and delivery window match it.

  • Transport risk and damage notice

    When the retailer commissions the transport in a consumer sale, the retailer bears the risk of damage or loss until the goods are handed to the customer (§ 475(2) BGB). Visible damage must be reported at delivery at the latest, hidden damage within seven days in text form (§ 438 HGB, German Commercial Code). That is why photos of the condition at handover and the customer's signature belong in the proof – and visible defects straight into a damage report.

  • Packing, loading, securing

    Under German carriage law the sender packs the goods so they are protected against loss and damage (§ 411 HGB) and loads them safely for transport unless agreed otherwise (§ 412 HGB). For furniture this means edge guards, blankets or film, glass inserts and keys packed separately, drawers and doors secured. During the drive the driver is responsible for compliant load securing (§§ 22, 23 StVO, German road traffic regulations): nothing may slide or tip over under emergency braking.

  • Appliances: take-back of old units stays with the retailer

    Retailers with at least 400 m² of sales area for electrical equipment must take back an old appliance of the same type free of charge when selling a new one. If the new unit is delivered to a household, collection there must be free for the customer, and the customer must be asked at purchase whether they want to hand an old unit back (§ 17 ElektroG). You organise this take-back and disposal yourself: Maxmove delivers the new fridge or oven but does not handle disposal.

  • Access, carrying, installation

    Whether delivery ends at the kerb or inside the flat is set by your sales contract – the order has to reflect it: floor, lift, stair width, walking route and a place to stop outside. For items that need two people, request carrying help. Assembly, wall mounting and connecting appliances are not part of the transport; your fitter or after-sales service remains responsible for them.
